5.45x39mm 7N6 Russian Surplus Ammo Ban

As many will know, the ATF pulled another fast one, and have banned the cheap 5.45x39mm 7N6 Russian Surplus Ammunition from importation into the USA.



Here is a letter someone posted online that he sent to his Senators regarding the import ban

"INSERT SENATOR NAME HERE,

The Bureau of Alcohol, Tobacco, Firearms and Explosives has recently stopped all import of Russian Military Surplus Ammunition in 5.45x39mm, citing it as "Armor-Piercing" and banned from import by the 1968 Gun Control Act. There are two problems with this blanket ban. The first is that the ammunition in question does not meet the exact definition of armor piercing in Section 921(a)(17)(B)(i) of the GCA. The second is that the ammunition in question was not designed to be fired from a handgun as defined in Section 921(a)(17)(B)(ii) of the GCA.

Section 921(a)(17)(B)(i) of the GCA states that "a projectile or projectile core which may be used in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium." The ammunition in quest does in fact have a steel core, however it also utilizes a lead alloy surrounding the steel core. Therefore, it is not constructed ENTIRELY from any of the named components as required by the referenced section of the GCA.

Section 921(a)(17)(B)(ii) of the GCA states that "a full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile." This section states that the round must have been DESIGNED AND INTENDED FOR USE IN A HANDGUN. The ammunition in question was designed to be fired from a rifle. The Russian Military developed the round to be utilized in the AK-74 rifle.

This import ban is a direct attack on the use of our 2nd Amendment rights and the decision by the ATF needs to be brought under review as soon as possible."

Comments

but someone posted this comment "a full jacketed projectile larger than .22 caliber" ....um.... 5.45 is smaller than .22

and his reply was:

exactly,.. .214 something, but well less that .22 and like I said above any full caliber rifle round will penetrate at least a 1/4 of rolled steel like .223 or 5.56 FMJ easily, doesn't make em armor piercing. The core of this surplus ammo isn't even hardened, here's a picture someone cut in half to prove that its mild steel and not hardened !



at which another comment was posted:

That's irrelevant as the law makes no mention of it being hardened and like a lot of other people you are focusing on the wrong paragraph. Paragraph (i) not (ii) is the relevant one.

Comment:

The 5.45x39 surplus 7N6 was so affordable, and this change by the ATF seems to have been made for one reason only, and that's to make shooting fiscally unaffordable by anyone but the rich.  And all ammunition prices and availability for the last several years seems to prove this fact, up to and including 22lr ammunition.

A few years ago the UN had been intentionally paying countries to destroy surplus ammunition such as (8mm Mauser, 303 British, etc.) so it would not be exported to the United States.  Thereby intentionally banning the importation of surplus military ammunition into the United States (as a means of punishing the United States for it's constitution that prevents our Govt. from INFRINGING in any way upon our Second Amendment right of the public ownership of firearms and ammunition.

So anti-gun forces within our country, are using the UN to fight against our God given rights.  For a while companies got creative, and used German importers to purchase the surplus ammunition that the UN had banned the US from purchasing, and exporting it to the US, but the UN found out about that work around, and closed that back door.

Now forces within our Govt (the ATF) are trying to prevent importation of surplus ammunition from Russia, as a means to make it unaffordable to all but the wealthy and powerful.

Our Govt has also used the EPA to close the last lead smelter in the U.S this year, and attacks on lead shot have it banned as well.  next the ATF will state that steel shot for hunting birds is obviously steel, therefore it should be banned, and the all new 5.56mm ammunition our Military is using, since it cannot use lead anymore is obviously not a full lead core, and therefor must be banned from public use for the very same reason.

The 1986 ban on the ownership of new machine guns post 1986 again not only an attack upon our rights, it also ended future R&D because that R&D was always paid for by the Citizens of the USA by legally purchasing them. now companies such as Colt who always had the contract to produce firearms for our military such as the m16 series rifles and carbines, and now FN and H&K are producing weapons for our own military.

The Modular accessories for the AR15 series rifles and carbines that are used by the US Military, had that R&D paid for by the public via purchasing, which is how all weapon technology advances, but the Govt has been pushing hard since 1994 (and before) to ban the ownership of these rifles, due to the very products that were created for the PUBLIC, and later adopted by the military without any need to pay for R&D.  technology advances has allowed the ability to shoot from the shoulder rifles such as the 50 BMG, noww allow the ability to push the size/caliber that can be fired from the shoulder, but the Govt bans anything above 50 caliber for no reason at all in this day and age.

The Govt instituted a plan based on the 1986 ban of "machine gun ownership" to ban weapon barrels from being imported, so those weapons can no longer be fixed.  and at the same time decimated hundreds of companies here in the US losing countless jobs.  those barrels are now being newly made, but again the costs are prohibitive.

The ATF used it's power to totally destroy historical firearms, by using massive demilitarization rules to destroy all but a few parts, in a country with our highest laws allowing the ownership of these very weapons, even when converted to semi-auto, yet countries outside the USA without any legal ownership of firearms, allow the very same weapons to be fully imported  just by welding a few parts, making it non-functional, yet a perfect museum display piece.  this is how far the Govt of the Land of the FORMERLY Free will go to attack the rights of it's citizens with a legal right to bear arms WITHOUT INFRINGMENT !   actually photo's should be posted of the before and after of UK demil, vs ATF demil requirements to show just how sickeningly far our govt has gone to INFRING upon our constitutional rights, compared to counties who have no rights !

We need to urge the gun lobbies to file a lawsuit to challenge this and other import bans in court.

The form approval went well past 2 weeks, which is the normal time frame for a Form 6 to be approved by the BATF.
